New financial measures for the 7th wave

Considering the efforts required to go through the summer, the ministère de la Santé et des Services sociaux has adopted new financial measures.

These measures come into force on July 22nd for the evening shift  for an undetermined time.

N.B. Theses measures are applicable to employees who do not meet the definition of “adequately protected” under Ministerial Order 2022-033 since November 9, 2022.

Measure 1 - Double-time pay of overtime for full time employees who work a shift of 4 hours or more in addition to the number of hours planned in a regular week based on their job title

Employees of categories 1 to 5, including non-unionized staff and “Je contribue” temporary hires, will receive double-time pay for their overtime when they work a complete overtime shift in addition to the number of hours planned in a regular work week based on their job title. The employee must respect their work schedule and not be absent from work during a seven-day period before and after the overtime shift.

Terms and conditions

  • Starting August 12th for the evening shift: The shifts worked in overtime must be of a minimal length of four (4) hours;
  • From July 22nd  to August 12th: The shifts worked in overtime must be full shifts;
    • Note that, from July 29, 2022, two half shifts (4 hours) worked in the same week are eligible to double-time pay;

  • Overtime must be entered using payroll code X2PAN;
  • The establishment is not required to accept an overtime offer related to this measure; overtime is granted based on the employer’s needs;
  • Note that for professionals eligible to overtime after 40 hours, double-time pay only applies after the 40th hour.

For eligibility purposes, the following hours are considered part of the regular work week:

  • Personal leaves provided for in the collective agreement;
  • The Labour Day statutory holiday taken on September 5th only;
  • The conversion of the evening or night shift premium;
  • Annual leaves;
  • Flexible leaves;
  • Parental leaves, including medical visits related to the pregnancy;
  • Absences related to COVID-19 (waiting for a result or positive test);
  • Leaves planned in the schedule for the organization of working time (OWT) or specific agreements (9/10 schedule, 4/32 schedule, etc.);
    • As long as there is no day without pay to fill the OWT, or the part-time measure will apply;

  • Union leaves.

Payment date

Overtime must be entered using payroll code X2PAN.

There will be no delay for the payment of the double-time pay; it will be included automatically (subject to the appropriate payroll code) on the pay that covers the work period during which the overtime took place (current pay period).

However, if criteria are not respected, there will be an automatic clawback of the half time pay on the next pay.

Measure 2 - Double-time pay of overtime for part time employees who work a shift of 4 hours or more weekend shift in addition to the hours planned in their assignment or job title

Part-time employees of categories 1 to 5, including non-unionized staff and “Je contribue” temporary hires, will receive double-time pay for their overtime when they work a complete weekend overtime shift in addition to the hours planned in their assignment or job title. 

The employee must respect their work schedule and not be absent from work during a seven-day period before and after the overtime shift.

Terms and conditions

  • The weekend starts on Friday with the evening shift and ends on Monday after the night shift;
  • Starting August 12th for the evening shift: The shifts worked in overtime must be of a minimal length of four (4) hours;
  • From July 22nd to August 12th: The shifts worked in overtime must be full shifts;
    • Note that, from July 29, 2022, two half shifts (4 hours) worked in the same week are eligible to double-time pay (other conditions must be respected);

  • Overtime must be entered using payroll code X2PAN;
  • The establishment is not required to accept an overtime offer related to this measure; overtime is granted based on the employer’s needs;
  • Note that for professionals eligible to overtime after 40 hours, double-time pay only applies after the 40th hour.

  • Leaves planned in the schedule for the organization of working time (OWT) or specific agreements (pre-retirement, partial parental leave or study leave, etc.) containing authorized days without pay;
    • Note that any other type of absence not planned in the schedule, paid or not, causes the loss of eligibility;

  • Union leaves.

Payment date 

Overtime must be entered using payroll code X2PAN.

There will be no delay for the payment of the double-time pay; it will be included automatically (subject to the appropriate payroll code) on the pay that covers the work period during which the overtime took place (current pay period).
